One year ago my wife was taking our daughter to pre-school turning left out the end of our road in to traffic, this road has a speed limit of 35 mph. Traffic had to stop to let her cross the first lane since it was solid cars, vans and small trucks. As she approached half-way, before getting a good view of oncoming traffic, another car took off the front bumper. Note that the center line is interuppted at the cross-junction. The bumper was torn from the front of the car with damage more evident on the non-impact side of the car than where initially hit, hence my wife had not initiated a turn, just edging forward to see. The radiator was in-tact, but damaged, still mounted to the front of the car. I walked to the site with our other child and took my daughter home; she is fine and I took her to school but still talks of the incident today. My wife stayed at the incident, and was fine (no later issues) keeping real calm and cooperating with police. It took about 2 hrs with police debating which town the incident took place (middle of the road is the divide) and the other driver was concerned about getting home to take a pot off the stove, but seemed medically fine. The driver asked me and the police to drive them home to get the pot off the stove and used my wifes cell phone more than once. They also wanted to drive their car home and leave the scene with a flat tire at one point I presume to attend to the pot. No tickets were issued, no air bags deployed. The other car had a flat front left tire and side damage so the drivers door was stuck shut. Both cars were old, so written off. Over a year later we received a court summons from their attorney and we are being sued for $750,000. Our limit is $100,000 on insurance. The plaintiff is claiming herniated discs and loss of bowel control. We have a 2006 no money down mortgage, so total equity is very much in the red since our home value plummeted. I have no umbrella policy. I am sole income, but was owner of the car my wife was driving. My wife is stay-at-home mom. The remaining $650,000 would be a big problem. Interestingly, we heard that the other driver called our insurance and asked for a >100-fold lower amount of money to just go away! Our insurer recalls this very clearly and did not pay. Questions: Should I invest in an attorney to work with our insurers attorney to cover the $650K over our limit? Do we have any case given the car the other driver may have been in a rush (as all were aware of the pot on the stove), would have settled for far less, and in reported safety tests should avoid an obstacle at 55mph let alone at the speed limit of 35 mph? Their case, as I understand, is to actually prove my wife was negligent, she was just trying to see. Reality and the law are complicated I understand. Our insurer is looking in to the validity of their medical claims. I believe for spinal and neck injuries plaintiffs have to follow careful insurance approved treatment plans in NJ. I know that such a condition may not be permanent with curative surgery possible to release the nerves that may be causing the bowel issue. The plaintiff has claimed the injury as permanent, do they need to prove this? Should we ask experts? The plaintiff lives in our town and their house is on my running route every other day. I have not noted anything at all and plan to stay away from all other parties. Should I change my running route? Thanks for any advice. Our 30 day clock is ticking.

I know there are other factors such as smokers/obese people, lawsuits, and people who don't pay their bills. But i'm wondering if insurance companies are one of the biggest reasons to blame for the ridiculously high cost of medical services and equipment? The reason I wonder is because the prices of medical care are so ridiculously high, but it seems like doctors can simply charge any price they want, no matter how ridiculous, because the insurance company will simply pay it. Unlike if someone was actually paying out of pocket and would actually say your out of your mind for charging that much, you won't get my business . I mean, seriously, even if doctors charged $70 per hour, thats still a high wage for them, and it wouldn't be too unreasonable for an hour of medical work, yet I hear of doctors performing various simple procedures that take like 5-15 minutes and charging hundreds or possibly thousands of dollars. Same thing with medical equipment. It seems any device classified as a piece of medical equipment sells for 10 times what it should reasonably cost to make it. Any level headed person would say they are insane for charging that much. But insurance companies simply pay it, and pass the cost on to the people. Making it so the people are basically getting ripped off through no choice of their own. And making it so people who don't have insurance simply cannot afford to have any care. PS: Another example of medical equipment. Just look at a hoverround wheelchair I've seen the retail price on those be over $9000, just for a middle class one. For a freaking electric wheelchair, that isn't even very great quality since they break down alot. You can purchase a brand new kia or hyundai car for like $7000-$9000. Ridiculous.

I've only been in one accident my entire life of driving and it wasn't my fault, a WOMAN backed into me as I was passing a parking lot. Apparently that wasn't the first time she did that either. Anyways the reason if this is true because I don't believe it men might have more accidents is because they're more likely to become drunk. Men drink and drive more, not only that but they probably like to show off more. rates should be higher for people like them, not all men. Gender biases are unconstitutional because that's prejudice. Also it's a total lie that women make less money than men. when i waited tables, the women got all the good tips from men. while i generally just got the minimum tip. not only that but sometimes if i was dealing with another male, sometimes they didn't give me a tip at all especially if they were drunk or some scruffy looking truck driver trying to hit on the other girls. But if one of those hot girls waited on them, they would sometimes give them a tip that was more than the food that they ordered! I think it's all bs. and of course completely racist. My car was broken into last night, between the hours of 9:30pm, and 7am, just parked in front of the condo we live in. Some things of value were taken, ( estimated around $130, or $150 in value...no damage was done to the car, they must've just picked the locks) so I filed a police report this morning...is this something I should report to my car insurance provider? If so, how would filing a report with insurance help me? I'm 19, and have been driving for a little over two years now, my insurance is through AAA. I have had no previous driving offenses on my record, or anything. (This has never happened to me before, so pardon some irrelevent info, here!) before. Do you recommend I file a claim with AAA, or just let the police handle it entirely? When would I need to file a claim by? (like, a deadline, time-wise.)

We rent an apartment at a big complex and each unit gets a carport. If you can picture it, it's just one large, covered structure with two 4'x4' wood poles separating each port. Coming home, one of us turned into the carport but the turn was a little too short and the car struck one of the poles. Fortunately it did not damage the carport, but the estimate for supplies and labor for a new pole to be cemented and installed was between $300 and $400. They don't care if we pay it out of pocket or file with our insurer, as long as they get their money. I am finding this tricky. It's a little more than I want to pay out of pocket knowing I have liabillity insurance but at the same time I am concerned about the effects on our insurance rates if a claim is files. I've been working with my employer for 7 years, as of right now I have employee & spouse coverage, I pay about 150 a month (auto deduct from paycheck) and that amount gets me a $5000 deductible and about a $25-$30 co-pay. this morning in a company meeting we were told that our insurance is going to go up (starting June 1st) now for employee and spouse it is going to be $410 a month (everything else the same as before co-pay and deductible) last year my hubby had some medical issues and we have about $7000 in medical bills (on a payment plan we pay $400 a month) so now when my new rate kicks in (in about a week) I will have to pay a total of $800 a month just for medical stuff... I can't afford this. my employer is very upset and wants to shop around but has been shopping around for 8 months now and can't find anything better than this. why is health insurance rising?? I am thinking about dropping myself from health insurance all together (I am 31 and healthy), also i plan on getting rid of my cable and internet (which would save $140 a month), my husband (with medical issues) will get health insurance through his work (about $160-$200 a month) and I will go without for a couple of years just so we can keep our heads above water... I just have a question about my plan of action- can I drop my Health insurance? will I get fined for opting out of health insurance when Obamacare goes into action next year?
